These general terms and conditions of sale apply by right to all sales of products concluded between :

 

ARTICLE 1 – PURPOSE

 

- The company MNP CORPORATE & ASSOCIÉS, a simplified joint-stock company with its registered office located at 26, rue Victor Schoelcher 68200 Mulhouse, France, and whose SIRET number is 850134701 00018.

Hereinafter referred to as "The Seller",

And,

- Natural persons who are non-traders with the capacity to contract wishing to make a purchase of one or more items marketed on the website accessible from the URL address https://www.markdebelleroy.com/.

Hereinafter referred to as "The Client",

 

In accordance with the provisions of article L 113-3 of the Consumer Code, these general terms and conditions of sale are brought to the Client's attention when placing the order; they are available on the website of MNP CORPORATE & ASSOCIÉS SAS.

MNP CORPORATE & ASSOCIÉS SAS may modify its general terms and conditions of sale at any time, published on its website https://www.markdebelleroy.com/.

The applicable general terms and conditions of sale are those in effect on the website https://www.markdebelleroy.com/ on the day the Client places the order.

 

 

ARTICLE 2 - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE


 

Any order placed by the Client implies their unconditional acceptance of these general terms and conditions of sale.

The Client is informed and agrees that the Seller may entrust delivery operations to third parties of its choice.

 

 

ARTICLE 3 – PRODUCTS


 

The products sold by MNP CORPORATE & ASSOCIÉS SAS are those listed on the website https://www.markdebelleroy.com/ on the day of the Client's consultation.

Each product is subject to a precise description, including the photograph, price, available colors, and main features.

Product photographs may include slight differences between the product and the illustration, depending on the color resolution of the Client's computer screen.

MNP CORPORATE & ASSOCIÉS SAS commits to delivering products that comply with legal and regulatory safety and health requirements.

ARTICLE 4 – ORDER


 

The Client places the order online, on the website accessible from the URL https://www.markdebelleroy.com/.

The Client must create a customer account in the "my account" section.

Any order placed by the Client obliges them to full payment at the time of placing the order.

Thus, any order will only be definitively considered after payment acceptance.

Any order cannot be modified once it has acquired the status "in preparation."

MNP CORPORATE & ASSOCIÉS SAS commits to fulfilling orders within the limits of available stock.

If the ordered item is unavailable, the Client will be informed without delay and will have the option to cancel their order and will be refunded within seven days.

In case of unavailability exceeding seven days or in case of permanent stock shortage, MNP CORPORATE & ASSOCIÉS SAS will cancel the order and refund the amounts paid by the Client.

MNP CORPORATE & ASSOCIÉS SAS has the right to cancel or refuse any order from a Client with whom there is a dispute regarding payment of a previous order.

ARTICLE 5 – PRICE



The prices indicated on the product sheets are expressed in Euros and include all taxes.

The applicable value-added tax is the one in effect in mainland France on the day of the order.

MNP CORPORATE & ASSOCIÉS SAS reserves the right to modify its prices at its discretion.

The ordered products are billed at the rates in effect at the time the order is recorded, subject to product availability.

The total price indicated in the order confirmation includes the price of the products, handling fees, and shipping costs.

Orders placed on the website https://www.markdebelleroy.com/, intended outside mainland France, may be subject to possible taxes and customs duties.

The Client is required to inquire about any applicable customs duties and possible fees relevant to their situation when placing an order.

These customs duties and any possible fees are the sole responsibility of the Client.

ARTICLE 6 - EXCHANGE AND RETURN

ARTICLE 7 - PURCHASE

When ordering in-store or on our website, please note that we cannot guarantee the immediate availability of the chosen product. Mark De Belleroy commits to informing you of the product's availability within 7 (seven) business days after the order. If available, the product will be delivered to the address you provided during the order, within a maximum of 30 (thirty) days from the order date. For certain specific or customized products, an additional delay may be necessary for their production.

ARTICLE 8 – PAYMENT TERMS



Upon acceptance of the order by the Seller, the Client agrees to pay the Seller the full payment.

Otherwise, the order will not be processed.

Payment for the order is made,

Transactions made on the website https://www.markdebelleroy.com/ are protected by the universal SSL (Secure Socket Layer) encryption system.

The Client's banking data is only known by the banking institution and does not pass through the web server of the website https://www.markdebelleroy.com/.

The information concerning your order is subject to automated data processing by MNP CORPORATE & ASSOCIÉS SAS
This automated data processing aims to combat bank card fraud.

MNP CORPORATE & ASSOCIÉS SAS is the sole recipient of the data related to the order.
Failure to transmit data prevents the analysis of the transaction.

The occurrence of a non-payment following fraudulent use of a bank card, an irregular declaration results in the registration of the details related to the order in a payment incident file.

ARTICLE 9 – DELIVERY TERMS



The ordered products are sent to the delivery address indicated by the Client at the time of order, provided that it is within the authorized delivery zones specified in the sales offer.

In case of error or omission by the Client in communicating the delivery address, MNP CORPORATE & ASSOCIÉS SAS cannot be held responsible for the inability to deliver the ordered products.

MNP CORPORATE & ASSOCIÉS SAS undertakes to deliver the products within a maximum period of seven (7) days from receipt of payment.

In case of delivery delay, not justified by a force majeure event, the Customer will have the right to request the termination of the sales contract and obtain a refund of the amounts paid within fourteen (14) days.

The cases of parcel returns by the carrier are the exclusive responsibility of the Customer.

We recommend that you check the condition of the packaging at the time of delivery. In case of apparent damage, please open your package in the presence of the carrier to check the condition of the product. If, upon delivery, you find that the ordered product is not available, the order will be automatically canceled and you will be fully refunded. This cancellation will not give rise to any compensation and Mark De Belleroy will be released from any delivery obligation.

ARTICLE 10 – RIGHT OF WITHDRAWAL



The Customer has the right to withdraw from this contract without reason within fourteen (14) clear days from the date they physically take possession of the good.

The Customer must notify by email their intention to withdraw from the sale within fourteen clear days, at the following address: contact@mnpcorporate-associes.com.

The customer may use the following withdrawal form or any other unambiguous statement:

I, the undersigned (name, first name, address), hereby notify you of my withdrawal from the contract concerning the sale of the good (specify the designation), ordered on (specify the date) and received on (specify the date).
Signature and date.

The customer will receive an acknowledgment of receipt of the withdrawal without delay.
For this withdrawal period to be respected, the Customer must send their communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.
In case of withdrawal, the costs resulting from the return shipment of the products will remain the responsibility of the Customer.

The consumer's liability is engaged in case of depreciation of goods resulting from handling other than those necessary to establish the nature, characteristics, and proper functioning of these goods, namely when items are returned incomplete, damaged, broken, used, or soiled.

ARTICLE 11 – WARRANTIES



The Seller undertakes to deliver an item conforming to the order placed by the Customer.

In case of non-conformity, the Seller is liable for defects of conformity of the item subject to the contract, under the conditions provided in article L 211-4 and following of the Consumer Code, as well as hidden defects of the sold item, under the conditions provided in articles 1641 and following of the Civil Code.

"Article L.211-5 of the Consumer Code:
To be in conformity with the contract, the item must:

1° Be suitable for the usual use expected of a similar item and, where applicable:
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer;
- have the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, notably in advertising or labeling;

2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."

When a claim under this legal warranty of conformity is made by the Customer, the request must be sent by email to the following contact address: contact@mnpcorporate-associes.com (please write "legal warranty of conformity" in the subject line) or by postal mail to the following address:

The customer is informed that when acting under the legal warranty of conformity, they benefit from:

- a choice between repair or replacement of the item. However, the Seller may not proceed according to the buyer's choice if this choice results in a manifestly disproportionate cost compared to the other option, considering the value of the item or the significance of the defect. The seller is then required to proceed, unless impossible, according to the option not chosen by the buyer.

The legal warranty applies independently of any commercial warranty that may be granted.

If the customer decides to invoke the warranty against hidden defects of the sold item, within the meaning of article 1641 of the Civil Code, and only in this case, they may choose either the cancellation of the sale or the price reduction in accordance with article 1644 of the Civil Code.

ARTICLE 12 – STOCK



The Customer is informed that, for products offered for sale on the website https://www.markdebelleroy.com/, delivery times and prices are only guaranteed within the limits of available stock.

 

ARTICLE 13 – RESERVATION OF OWNERSHIP



The products are sold under reservation of ownership.

The Seller retains ownership of the products until full payment of the price by the Client.

 

ARTICLE 14 – FORCE MAJEURE



Neither party shall be held liable if prevented or delayed in performing its obligations due to force majeure, resulting from an unforeseeable, irresistible event beyond their control.

Notably, in case of fire, climatic events, natural disasters, or any other accident causing total or partial destruction of the company, a general strike, lack of driving power or raw materials resulting from a general cause.

In case of force majeure, delivery will be postponed to a later date after the cessation of the force majeure event, without the Client or the Seller being able to claim any compensation for any damage whatsoever.

If the force majeure event lasts more than four (4) weeks, each party will have the option to terminate the contract by registered letter with acknowledgment of receipt, without any cost.

In this case, the Seller will refund the amounts paid by the Client when placing the order, excluding any other compensation owed by the Seller to the Client.

 


ARTICLE 15 – CONTACT AND CUSTOMER SERVICE



To exercise their right of withdrawal, the Client must send an email to MNP CORPORATE & ASSOCIÉS SAS, at the following address: contact@mnpcorporate-associes.com.

For tracking the execution of their order, the Client can log in to the "my account" section on the website https://www.markdebelleroy.com/.

ARTICLE 16 – INFORMATION AND PERSONAL DATA



Under law no. 78-17 Informatique et Libertés of January 6, 1978, the Client has the right to access, rectify, and object at any time to all their personal data by sending a request by mail to MNP CORPORATE & ASSOCIÉS SAS, 26, rue Victor Schoelcher 68200 Mulhouse.

Depending on the choices made by the Client when creating or consulting their Client account, the Client may receive offers from MNP CORPORATE & ASSOCIÉS SAS, its service providers, and its partners.

The Client may at any time request a modification of the choices made, either by accessing the "my account" section on the website https://www.markdebelleroy.com/, or by sending a request by email to the address contact@mnpcorporate-associes.com.

We are committed to respecting your privacy and protecting your personal data in accordance with current regulations, notably the General Data Protection Regulation (GDPR). A detailed privacy policy will be implemented on our website to ensure the security and confidentiality of your personal information.

Please note that products purchased from our retailers or on our website can only be exchanged for a product of equivalent quality in original condition. No refunds will be made for items purchased from our partners or directly from Mark De Belleroy. This policy ensures the quality and integrity of our products while providing a satisfactory solution in case an exchange is needed.

ARTICLE 17 – INTELLECTUAL PROPERTY
 

 

All texts, comments, images, and product photographs reproduced on the website contact@mnpcorporate-associes.com are the exclusive property of MNP CORPORATE & ASSOCIÉS SAS and are protected by copyright law.

Any reproduction, even automated, of product presentation pages or any other pages of the site, for commercial purposes, is prohibited.
Only automatic indexing of the site pages resulting from natural referencing in internet search engines is authorized.

"Mark De Belleroy" is a registered trademark in red, accompanied by a red rectangle in the vertical direction, without any mention, owned by MNP CORPORATE & ASSOCIÉS SAS, and registered with the INPI.

Thus, in accordance with the provisions of the Intellectual Property Code, only the use of texts, comments, and images for private use is authorized.

Any other use constitutes an act of counterfeiting.

MNP CORPORATE & ASSOCIÉS SAS reserves the right to initiate all legal proceedings to protect its rights against any person acting in violation of these provisions.

ARTICLE 18 – APPLICABLE LAW AND COMPETENT JURISDICTION

These general terms and conditions of sale are governed by French law.

Any dispute between the Seller and the Customer arising from the formation, interpretation, or execution of the sales contract shall, failing an amicable solution, be subject to the territorially competent Courts.

ARTICLE 19 - WARRANTY OF MARK DE BELLEROY CAPS

At Mark De Belleroy, we are proud of the exceptional quality of our caps. That is why we offer a limited 5-year warranty on certain essential components of our products:

  • The rivet at the top of the cap

  • The clasp at the back of the cap

  • Main seams (subject to normal use)

Scope of the warranty


This warranty covers manufacturing defects of the components listed above under normal and proper use of the product. It includes:

  • The rivet detaching without excessive force.

  • The clasp malfunctioning without misuse.

  • Seams that come undone due to a manufacturing defect.

 

Warranty exclusions and limitations


This warranty does not cover the following cases:

  1. Rivet damaged by improper handling

    • Any excessive or intentional intervention on the rivet.

  2. Clasp broken due to misuse

    • Clasps forced or damaged due to mishandling or an accident.

  3. Seams damaged by misuse

    • Seams damaged by excessive tension or misuse.

  4. Natural and environmental wear

    • Normal wear, discoloration, or damage caused by inappropriate environmental conditions.

  5. Aesthetic damages

    • Scratches, scuffs, and other aesthetic damages that do not affect the product's functionality.

 

Purchases from official partners


This warranty applies only to products purchased directly on our official website www.markdebelleroy.com or from our official reseller partners. Any purchase made outside these channels will not be covered by this warranty. The list of our official partners is available on our website. When making a claim, an original proof of purchase from an authorized distributor will be required.

Customer obligations


For any warranty claim, the product must be returned in its original condition, accompanied by the following items:

  • Original invoice: Photocopies, screenshots, or duplicates will not be accepted. Only the original invoice is valid.

  • Original box: The product must be returned in its original box without damage.

  • Certificate of authenticity: Each product must be accompanied by its certificate of authenticity.

  • All accessories provided with the product: No items should be missing (e.g., protective bag, tag, etc.).

Failure to comply with these requirements will result in automatic denial of the warranty request.

Claim procedure

  1. Submitting a claim
    The customer must provide a detailed description of the problem, photos of the damaged product, and the original invoice. If the product was purchased from an official partner, proof of purchase must also come from that authorized distributor.

  2. Claim evaluation
    If the product was not purchased through an official channel or if the return conditions are not met, the claim will be automatically denied. If the product meets the criteria, a thorough evaluation will be conducted.

  3. Product return
    The product must be returned complete, with its box, certificate of authenticity, original invoice, and all original accessories. Incomplete returns will not be processed and will be sent back to the customer at their expense.

  4. Shipping costs

    • If the claim is accepted, Mark De Belleroy will cover the repair or replacement costs, as well as the return shipping fees.

    • If the claim is denied, shipping costs will be borne by the customer, including the return shipping fees for the uncovered product.

Processing time


Product evaluation will take up to 30 business days. If the warranty applies, repair or replacement will be carried out within an additional 10 to 15 business days.
